Terms and conditions of sale

Article 1 — Purpose and scope

These general terms and conditions of sale (hereinafter the "Terms") govern the relationship between EURL PWG POWDERWEGO, operating under the name PowderWeGo as an off-piste ski school and outdoor-activities business (hereinafter "the school"), and any person booking one of its services (hereinafter "the client").

Any booking implies full acceptance of these Terms. They supplement the site's legal notice and prevail over any other document, unless the school has accepted specific written conditions.

Article 2 — Services offered

Depending on conditions and availability at the time, the school offers:

  • piste ski lessons, private or in a small group;
  • guided off-piste skiing outings;
  • ski-touring courses and outings;
  • day trips in the Tarentaise;
  • heliskiing on the Italian side, organised with authorised local partners and subject to specific logistics and regulations;
  • private week-long bookings and tailor-made formats.

Instruction and guiding are provided by a qualified ski instructor; for certain routes that require one, a mountain guide may occasionally be engaged. The services are subject to an obligation of means (obligation de moyens): the school applies all its expertise to the success and safety of the outing, without being able to guarantee a result that also depends on snow conditions, the weather and the client themselves.

Article 3 — Required level and physical fitness

Our off-piste, ski-touring and heliski outings are intended for skiers who are already self-sufficient on all pistes. It is the client's responsibility to assess their technical level and physical condition honestly in relation to the service chosen, and to inform the school of any health matter that may affect their skiing.

The school advises each client as best it can and may, at any time, adapt, redirect or refuse a service when the level, the client's form on the day or their equipment is not compatible with safe guiding. A service refused or interrupted for this reason does not give rise to a refund.

Article 4 — Booking, quote and formation of the contract

Every request gives rise to a quote or a written confirmation stating the service, the date, the number of participants and the price. The booking becomes firm on receipt of the client's agreement and of the payment provided for in Article 6.

Article 5 — Price and what it includes

Prices are given in euros. Unless otherwise stated in the quote, the price of a service includes guiding by the professional and, for outings away from the pistes, the safety kit (avalanche airbag pack, avalanche transceiver, shovel and probe), provided and checked.

Not included, unless expressly stated: lift passes, ski equipment hire (skis, boots, poles), transfers, meals, accommodation, helicopter rotations for heliskiing, and the client's personal insurance.

Article 6 — Payment

The booking is made by payment in full for the service. Accepted means of payment are stated in the quote.

Article 7 — Cancellation or postponement by the client

Any request for cancellation or postponement by the client must be sent to the school in writing. The following conditions apply:

  • More than 30 days before the start of the service · cancellation accepted and fully refunded
  • From 30 to 15 days before the start of the service · 50% of the amount retained by the school
  • Less than 15 days before the start of the service · the service is no longer refundable
  • No-show at the meeting point · the full price remains due, with no refund

As far as its availability allows, the school endeavours to offer a postponement rather than an outright cancellation.

Article 8 — Cancellation, postponement or change by the school: weather and safety

The mountain is in charge. The instructor or guide alone decides to cancel, postpone, shorten or change the route of an outing for any safety reason: weather conditions, avalanche risk, the state of the snowpack, closure of the ski area or of sectors, unavailability of a partner (in particular for heliskiing). This decision, taken in the client's interest, cannot give rise to any liability on the part of the school.

  • When the school cancels a service before it begins for such a reason, it offers the client a postponement or, failing agreement, a refund of the sums paid for the cancelled service, to the exclusion of any other compensation.
  • When the service takes place but the client chooses to give up part-way, or when the route is adapted for safety reasons, no refund is due once the guiding has been provided.

Weather and snow conditions do not in themselves constitute grounds for cancellation or refund at the client's initiative as long as the school continues to provide the service.

Article 9 — Conduct of the services and the client's obligations

The client arrives at the agreed meeting point and time, with suitable ski equipment in working order. Wearing a helmet is strongly recommended for any skiing away from the pistes.

For off-piste, ski-touring and heliski outings, the avalanche safety equipment (avalanche airbag pack, avalanche transceiver, shovel, probe) is provided by the school. The client undertakes to carry this equipment, to use it in accordance with instructions, and to follow the instructions of the instructor or guide at all times. Failure to comply with safety instructions may lead to immediate exclusion from the outing, without refund.

Article 10 — Liability and insurance

Off-piste skiing, ski touring and heliskiing take place in a natural mountain environment and involve risks that guiding reduces but never eliminates. The school is bound by an obligation of means and cannot be held liable for the consequences of an external event, a case of force majeure, the act of a third party or the client's failure to follow the instructions given.

The school holds professional liability insurance with MAIF (contract Assurance Professionnelle Formule 2, member number 8301878M; cover set out in the legal notice).

This insurance does not cover damage suffered by the client as a result of their own skiing. The client is strongly advised to take out, before the service, personal insurance covering off-piste skiing and including rescue on and off the pistes, repatriation, medical costs and cancellation. The school can point out what to check, but taking out cover is the client's responsibility.

Article 11 — Right of withdrawal

In accordance with Article L221-28, 12° of the French Consumer Code, the right of withdrawal does not apply to leisure services provided on a specific date or at a specific frequency. The school's services, booked for agreed dates, are therefore not subject to the fourteen-day right of withdrawal.

Article 12 — Complaints

Any complaint about a service should be sent to the school by email at infoskitravels@powderwego.com or by post to the contact address, as soon as possible after the service. The school undertakes to reply promptly, with a view to an amicable settlement.

Article 13 — Consumer mediation

Having first contacted the school, and failing a satisfactory reply within two months, a client who is a consumer may use a consumer mediator free of charge. [TO CONFIRM: name, postal address and website of the consumer mediator the school falls under.]

Article 14 — Personal data

Data provided in connection with a booking is processed in accordance with our data protection policy, set out in the legal notice. The client has the rights of access, rectification and erasure provided for by the GDPR.

Article 15 — Governing law and disputes

These Terms are governed by French law. Failing an amicable settlement or successful mediation, any dispute falls within the jurisdiction of the competent French courts.

In the event of any discrepancy between this English version and the French version, the French version prevails.
